General Terms and Conditions
1. Scope
The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively for consumers.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
2. Contractual partner, conclusion of contract, correction options
The purchase contract is concluded with SB-MediaToys.
By placing products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.
3. Contract language, storage of contract text
The language(s) available for concluding the contract: German
We save the contract text and send you the order data and our GTC in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Subject of the contract

The validity of the respective product description as an essential part of the contract is hereby pointed out.

Due to individual screen configurations (e.g. resolution and brightness), slight deviations between the displayed and the actual product colors are possible.
5. Delivery conditions
5.1 Shipping costs
In addition to the prices indicated, standard shipping incurs shipping costs of 5.99 Euro.
5.2 Delivery options
We ship the products to the delivery address specified in the ordering process.
We only deliver via shipping. Unfortunately, self-collection of the goods is not possible.
6. Payment
In our shop, you generally have the following payment methods available.
Prepayment
If you choose the prepayment payment method, we will provide you with our bank details in a separate e-mail and deliver the goods after payment is received.
SEPA Direct Debit
By placing the order, you grant us a SEPA direct debit mandate. We will inform you of the date of the account debit at least one banking day in advance (so-called pre-notification). A banking day is any working day with the exception of Saturdays, federal legal holidays, and December 24 and 31 of each year. The account debit takes place after the goods have been shipped.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further instructions can be found in the order process.
PayPal may offer additional payment methods to registered PayPal customers selected according to its own criteria in the customer account. However, we have no influence on the offering of these methods; further individually offered payment methods concern your legal relationship with PayPal. Further information on this can be found in your PayPal account.
7. Warranty and Guarantees
7.1 Liability for defects
The statutory liability for defects applies.
7.2 Guarantees and customer service
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
8. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation
- in case of injury to life, body or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, if agreed, or
- as far as the scope of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here. Consumers have the option to use this platform for resolving their disputes.
To resolve disputes arising from a contractual relationship with a consumer or regarding whether such a contractual relationship exists at all, we are obligated to participate in dispute resolution proceedings before a consumer arbitration board. The competent body is the Universal Arbitration Board of the Federal Government at the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, https://www.universalschlichtungsstelle.de/. We will participate in a dispute resolution procedure before this body.
10. Youth protection
If your order includes products subject to age restrictions, we ensure through the use of a reliable procedure involving personal identity and age verification that the customer has reached the required minimum age. The deliverer, if delivery takes place, only hands over the goods after age verification and only to the customer personally. Delivery to packing stations is not possible in this case.
Should individual clauses of these General Terms and Conditions be wholly or partially ineffective, the remainder of the contract shall remain effective. Insofar as individual clauses are ineffective, the content of the contract shall be governed by the statutory provisions.
